Here are some facts regarding drug crimes that you may not be aware of:
From simple possession to drug trafficking, all drug arrests and drug charges are considered felonies, with the only exception being possession of less than one ounce of Marijuana. All drug offenses are serious offenses that should not be taken lightly!
You may be charged with a drug crime, even if the alleged drugs were not on your person or in your possession. This is a legal theory known as “constructive possession.” It will most likely occur after a search of a house or vehicle where several people are present and no one claims ownership of the alleged drugs. In these scenarios, the police look at several facts when arresting a person for “constructive possession.” Some factors police consider include:
- Your location in relation to where the drugs were found. For example, the drugs were on a table in house that you were staying at or were under a car seat near where you were sitting.
- Whether you had any power or control over the drugs.
- What were you doing prior to finding the drugs. For example, riding in back seat of a car behind the driver and the drugs were seen being thrown out of the driver side window.
- Prescription drugs are treated the same as any “hardcore” drug when it comes to drug possession. If you have pills that are not in a pharmacy container and you do not have a prescription for them, you will be arrested. All Scheduled Controlled Substances (no matter the drug schedule) can lead to an arrest, if you do not have a proper prescription.
